The Virginia Alcoholic Beverage Control Authority employs over 4,000 full-time and part-time employees and is seeking individuals robust of character with refreshing notes of motivation and reliability to work in a fun and spirited environment.

Virginia ABC is tasked with controlling the distribution of alcoholic beverages and efficiently operating 393 conveniently located retail outlets throughout the state. Additionally, we are charged with enforcing the laws of the Commonwealth pertaining to alcoholic beverages and youth access to alcohol and tobacco products.

The Virginia Alcoholic Beverage Control Authority is a public law enforcement and retail sales Authority with the mission of Control, Service and Revenue. The Division of Hearings, Appeals and Judicial Services effectively and efficiently reviews, hears, and decides contested license applications, licensee disciplinary cases, franchise cases and conduction mediations.

This position is contingent upon approval of funding. The final selection of a candidate is subject to funding availability.

Description

Virginia ABC seeks an Administrative Law Judge to conduct pre-hearing conferences and formal administrative hearings in compliance with the Virginia Administrative Process Act, the Code of Virginia and ABC Board regulations and policy.

Selected candidate will be responsible for deciding procedural, factual, and legal issues involved in the hearing and appeals process; evaluating and ruling on evidentiary and pre-trail matters including request for continuances; interpreting and applying applicable law, regulations, and policy; advising and assisting staff and interested parties in conducting hearings and appeals business; determining appropriate sanctions consistent with applicable law, regulations, and policy; issuing timely logical and understandable decisions and rulings; and ensuring timely, efficient, and effective conduct of hearings and appeals under established policy and standards.

In addition, the selected candidate will assist with the preparation of legislation, work with Authority stakeholders on policy and legislative matters with potential impact on the Authority programs. The selected candidate will prepare executive summaries of legislation, develop fiscal impact statements on designated legislation, draft enrolled bill reviews, and advise Authority divisions on legislation during the course of the General Assembly session.

Statewide travel is required; the selected candidate must be available to travel when necessary and possess a valid Virginia driver’s license.

Minimum Qualifications

• Juris Doctor (J.D.) degree from an accredited law school.
• At least five (5) years of relevant legal experience, or an equivalent combination of education and experience.
• Experience conducting administrative or judicial hearings and drafting judicial decisions in Virginia state courts.
• Strong organizational, written and verbal communication, and interpersonal skills, with the ability to manage multiple priorities, maintain confidentiality, exercise sound judgment, work effectively both independently and collaboratively, and adapt to changing business needs.
• Proficiency with Microsoft Office Suite (including Word and Excel) and other technology applications required to perform the duties of the position.
• Valid Virginia driver's license.

Preferred Qualifications:

• Experience working with the Virginia General Assembly or in a legislative environment.
• Active member in good standing with the Virginia State Bar.
• Prior experience serving as an Administrative Law Judge, hearing officer, or presiding officer for a state administrative agency.
• Experience with alcoholic beverage control, licensing, or regulatory enforcement matters.
• Familiarity with Title 4.1 of the Code of Virginia (Alcoholic Beverage Control Act).
• Demonstrated ability to draft clear, well-reasoned, and legally defensible decisions while meeting statutory deadlines.
